On July 31, 2025, Sean Davis (@seanmdav) posted on X that Kevin Clinesmith is a convicted felon, that the D.C. Bar restored his license after the conviction, and that Jeff Clark has been convicted of nothing. Davis quoted Kyle Cheney about a D.C. Bar Board on Professional Responsibility recommendation that Jeff Clark be disbarred. That post is selected commentary. It is not this file’s findings.
This page does not adopt Davis’s wording that Clinesmith “fabricated evidence” so the FBI could “fraudulently obtain an illegal spy warrant,” and it does not treat “forged a FISA” as fact. The conviction is one count of making a false statement, 18 U.S.C. § 1001(a)(3), for altering a CIA/OGA email that the affiant used on the fourth Carter Page FISA application. What the D.C. Court of Appeals did say is on the discipline post: In re Kevin E. Clinesmith, No. 21-BG-18 (Sept. 2, 2021). One-year suspension nunc pro tunc to August 25, 2020. The Hearing Committee said the crime was serious but not moral turpitude, and that the sanction was “not unduly lenient.”
